NCR Corp. and Appleton Papers Inc. will not have to pay for the cleanup of PCBs from Little Lake Butte des Morts and southern portions of the lower Fox River, a federal judge ruled this week.
U.S. District Judge William Griesbach of Green Bay issued the ruling based on testimony he heard in February during a seven-day bench trial.
The two companies won their argument that they can’t be held solely responsible — especially upstream on the Fox — for discharging toxic polychlorinated biphenyls into the river in the 1950s and 1960s.
